			<content:encoded><![CDATA[<p>If you operate a motorboat or PWC in Virginia, you need to you know about Virginia&#8217;s boating safety education requirements.</p>
<p>In 2007, the Virginia General Assembly enacted a law to establish a boating safety education compliance requirement. This requirement will be phased in over the next several years and by 2016, all operators of PWCs (Personal Watercraft such as jet skis, Sea Doos, Wave Runners) and operators of Motorboats with a 10 hp or greater motor, will be required to have a boating safety education course completion card on board when operating a PWC or Motorboat.</p>
<p>As of July 1, 2009, all PWC operators 20 years old and younger must complete a boating safety course. This is the beginning of the phase-in of the Education Compliance Requirement for all Virginia boaters.</p>
<p>Beginning July 1, 2010, all PWC operators 35 and younger must complete a boating safety course.</p>

			<content:encoded><![CDATA[<p>The Commission&#8217;s Summer Flounder, Scup and Black Sea Bass Management Board has modified the 2010 season length for the black sea bass recreational fishery. The season will now run from May 22 to October 11, 2010 and from November 1 to December 31, 2010.</p>
<p>The season represents an extension from what was originally planned. When the original season was developed, the Board only had 2009 harvest estimates for January through June. Harvest estimates for July through December 2009 were projected using previous years’ data to calculate a total harvest estimate.</p>
<p>Based on these preliminary projections, the original season was developed with the intent of reducing recreational harvest by 44% from 2009 levels.</p>
<p>Final 2009 harvest estimates were made available at the end of April.  The estimate indicates that harvest is less than previously projected and only a 21.4% reduction is required for the 2010 recreational season.</p>
<p>The newly approved season is anticipated to achieve a 26% reduction and allows for a reasonable conservation buffer to account for uncertainty in the harvest estimates and the effectiveness of regulations.</p>
<p>The season was further expanded into November and December to allow for increased access by party/charter boats and private boat/shore-based anglers that did not have a late fall/early winter season last year.</p>

			<content:encoded><![CDATA[<p>In a vote supported by all member states of the Atlantic States  Marine Fisheries Commission&#8217;s (ASMFC) Summer Flounder, Scup and Black  Sea Bass Management Board, states will now have the option to liberalize  the 2010 black sea bass season in state waters by an additional 90  days. The proposed new season will run from May 22 through October 11,  with an additional open period of November 1 through December 31.  The  proposal would keep the size and bag limit the same of 12-1/2 inches and  25 fish per angler.</p>
<p>The changes come following a bitter struggle by East Coast fishermen  to save the recreational fishery for black sea bass. When NOAA Fisheries abruptly closed  the recreational sea bass fishery last October without any opportunity  for public comment, the RFA immediately began working on a legal  challenge to fight the closure.</p>
<p>The RFA, United Boatmen and a coalition  of industry allies (the &#8220;Plaintiffs&#8221;) filed suit on November 4, 2009 in  New Jersey Federal Court arguing that the sea bass closure should be  declared unlawful and set aside for being arbitrary, capricious, an  abuse of discretion, and otherwise not in accordance with law pursuant  to the Administrative Procedure Act.</p>
<p>&#8220;The emergency  closure of the recreational sea bass fishery was unprecedented for a  fishery that is not &#8216;overfished&#8217; and where &#8216;overfishing is not  occurring&#8217;,&#8221; said Jim Donofrio, RFA Executive Director. &#8220;This case is  about more than just sea bass; it&#8217;s about taking a stand against a  federal agency abusing its power and hurting individuals and small  business owners.</p>

			<content:encoded><![CDATA[<p>The Mid-Atlantic Fishery Management Council (Council) and four of its Committees met in Duck, North Carolina from April 13 until April 15, 2010.</p>
<p>The Council voted to send a letter to NMFS, upon receipt of NMFS&#8217; black sea bass proposed rule, to support adoption of the ASMFC 2010 Black Sea Bass recreational measures of a 3.7 million pound total allowable landings (TAL), a 12.5&#8243; minimum fish size, a 25 fish possession limit, and a season of May 22 through September 12.</p>

			<content:encoded><![CDATA[<p>2010 may shape up to be a good year for flounder fishing in Virginia. After a harsh winter, anglers have had several days of mild weather in the early season. Catches of flounder along Virginia&#8217;s eastern shore came as early as the second weekend in March. More mild weather is expected to improve catches as the season progresses.</p>
<p>The Virginia Marine Resources Commission has voted to lower the size limit for flounder this year.  The new regulations set the new size limit at 18.5 inches, down from 19 inches, but reduce the bag limit from five to four flounder per day for the rest of the year.</p>
<p>In Virginia&#8217;s Potomac River tributaries the minimum size limit, closed season, and possession limit will be the same as established by PRFC for the mainstem Potomac River.</p>

			<content:encoded><![CDATA[<p>The VMRC has voted on flounder size regulations for the 2010 season.  The new regulations set the flounder size limit at 18.5 inches, with a creel limit decreased to four fish per day, with no mid-season closure.</p>
<p>VMRC also voted to reduce the daily limit of six weakfish to one fish a day for recreational anglers, and to reduce the commercial harvest to 100 pounds per day or trip, whichever is longer. These actions were taken in order to meet mandated Atlantic States Marine Fisheries Commission harvest reductions.  The reductions were a result of data that shows the species has been highly depleted on a coastwide basis. The catch reductions will take effect May 1, 2010.</p>

			<content:encoded><![CDATA[<p>The General Assembly has passed Senator Northam’s SB668 to exempt Virginia anglers from having to pay the $25 fee associated with the Federally-mandated National Saltwater Angler Registry.</p>
<p>SB668 has been amended to create a state-level angler identification system, similar to the Hunter Identification Program run by the Virginia Department of Game and Inland Fisheries.</p>
<p>This solution will allow Virginia to maintain the recreational boat license, as well as the license exemptions for piers, rental boats, senior citizens, and private shoreline. The state program will be administered through the Virginia Marine Resources Commission, and will be paid for through increases of up to $5 on individual licenses, and up to $10 on boat  licenses. Instead of paying the Federal government to register, anglers with a Virginia license will be registered automatically, and anglers exempted from Virginia licensing requirements will only have to call in and obtain an identification number free of charge.</p>
<p>“As is the norm with compromises, this one is not perfect,” said Northam. “However, it does accomplish the goals of exempting Virginians from Federal fees and fines, and also allows us to keep the boat license, as well as all existing license exemptions.”</p>
<p>The legislation was introduced in response to a VMRC study that provided options on how Virginia could comply with the Federal mandate.  The data collected from the new system will improve the quantity and quality of data available to manage<br />
fisheries sustainably, and will help prevent the kind of stock collapses that have led to massive job losses, regional economic depressions, and serious environmental effects in the past.</p>
<p>The bill was reported from a conference committee and passed the Senate and House of Delegates. It will now go to Governor McDonnell for his signature.</p>

			<content:encoded><![CDATA[<p>The Coast Guard base on Chincoteague Island is scheduled to host an event for mariners to come and meet locally based federal and state law enforcement officers March 10 at 6:30 p.m.</p>
<p>The event will provide an opportunity for mariners to meet some of their local enforcement officers, ask questions and learn about new and existing regulations.</p>
<p>Regardless of whether mariners operate a commercial, charter, or recreational vessel; subject matter experts will be on hand to answer questions about recreational and commercial fishing, or questions about laws pertaining to safety gear.</p>
<p>Boaters without specific questions are invited to come and listen to the discussion or pick up information on Boating Safety, Commercial Fishing Vessel Safety, Fishing Regulations, or to come and schedule a Courtesy Marine Examination.</p>
