United States Announces Continued Support for International Proposal to Protect Bluefin Tuna

Assistant Secretary of the Interior for Fish and Wildlife and Parks Tom Strickland has announced that The United States will continue its support for a proposal to ban all international commercial trade of Atlantic bluefin tuna at this month’s meeting of the Convention on International Trade in Endangered Species of Wildlife Fauna and Flora (CITES) in Doha, Qatar.

Strickland, who will head the U.S. delegation to the 15th Conference of Parties (CoP15) of the 175-nation treaty, initially announced support for the proposal last October, but left open the possibility that the United States could modify its position if the International Commission for the Conservation of Atlantic Tunas (ICCAT) adopted significantly strengthened management and compliance measures during its November 2009 meeting.

“Under the leadership of NOAA, the United States entered the meeting seeking the strongest possible agreement for the conservation of eastern Atlantic and Mediterranean bluefin tuna. We recognize that the parties to ICCAT took some unprecedented steps,” said Strickland. “However, in light of the serious compliance problems that have plagued the eastern Atlantic and Mediterranean fishery and the fact that the 2010 quota level adopted by ICCAT is not as low as we believe is needed, the United States continues to have serious concerns about the long-term viability of either the fish or the fishery.”

The Atlantic bluefin tuna is highly prized, especially for sashimi, and a single fish can be sold for tens of thousands of dollars. The Eastern Atlantic and Mediterranean stock is threatened by overharvesting, which includes illegal, unregulated, and unreported fishing.

Current population information for the species shows it meets the biological criteria for listing in Appendix I. In the Atlantic Ocean, bluefin tuna are managed as two separate stocks, an Eastern Atlantic and Mediterranean, and a Western. The Eastern Atlantic and Mediterranean stock of the Atlantic bluefin tuna has declined steeply during the last 10 years. Based on estimated catches, scientists estimated the spawning stock biomass in 2007 to be 78,724 metric tons. This contrasts with the biomass peak of 1955, at 305,136 metric tons. The decline over the 50-year historical period ranging from 1955 to 2007 is estimated at 74.2 percent, the bulk of which (60.9 percent) took place during the last 10 years.

The Western Atlantic spawning stock has declined by 82.4 percent from 49,482 metric tons in 1970 to 8,693 metric tons in 2007.  During the past decade, the Western stock has stabilized at a very low population level. Many experts correlate this stabilization to adoption of rigorous science-based catch quotas and other management measures together with effective monitoring and enforcement. Such measures ensured strict compliance with ICCAT’s ruled by the U.S. fleet.

Strickland noted that the parties to ICCAT took positive steps at the November meeting. These steps included a commitment to set future catch levels in line with scientific advice, to shorten the fishing season, reduce fishing capacity, and close the fishery if the stocks continue to decline.  However, in light of the serious compliance problems that have plagued the eastern Atlantic and Mediterranean fishery and the fact that the 2010 quota level adopted by ICCAT is not as low as needed, the United States will support the proposal to list Atlantic bluefin tuna in Appendix I at CoP15 and will work actively with Monaco and other CITES and ICCAT Parties in order to achieve positive results for bluefin tuna at CoP15 and at the 2010 ICCAT annual meeting.

If the bluefin tuna is listed under Appendix I, commercial fishermen in the United States could continue to sell western Atlantic bluefin tuna caught in the U.S. Exclusive Economic Zone (EEZ) domestically.  Fishing in the EEZ is tightly regulated in the United States to ensure that it meets the ICCAT science-based quota. The United States is both a consumer and a net importer of Atlantic bluefin tuna. Strickland indicated that the United States will explore measures to assist fishermen if international trade is restricted.

“We understand the frustration of our U.S. fishermen who have followed the scientific recommendations and regulatory provisions of ICCAT for many years while their counterparts in the eastern Atlantic and Mediterranean have often overfished and engaged in ineffective management,” Strickland said.  “The U.S. government is committed to working with our many international partners to continue to rebuild Atlantic bluefin tuna and ensure sustained conservation and management of the species into the future.”

A CITES-regulated species may be included in one of three appendices to the convention:

* Appendix I includes species for which it is determined that any commercial trade is detrimental to the survival of the species. Therefore, no commercial trade is allowed in Appendix-I species. Non-commercial trade in such species is allowed if it does not jeopardize the species’ survival in the wild. Permits are required for the exportation and importation of Appendix-I species.

* Appendix II includes species for which it has been determined that commercial trade may be detrimental to the survival of the species if that trade is not strictly controlled. Trade in these species is regulated through the use of export permits.

* Appendix III includes species listed by a range country that requires the assistance of other parties to ensure that exports of their native species are legal. Permits are used to control and monitor trade in native species. Any CITES party may place a native species in Appendix III.

Any listing of a species in either Appendix I or II requires approval by two-thirds of the CITES party countries that vote on the proposal.

The Conference of the Parties will be held March 13-25, 2010, in Doha, Qatar.

NY Senator Calls For Moratorium On Flawed MRFSS Data

U.S. Senator Charles E. Schumer (D-NY) has called on U.S. Secretary of Commerce Gary Locke, NOAA Administrator Jane Lubchenco, and NMFS Administrator Patricia Kurkul to issue an immediate moratorium on the flawed survey data used to implement recreational fishing quotas for the East Coast.  In a letter addressed to Kurkul, Sen. Schumer cited the Marine Recreational Fishing Statistical Survey (MRFSS) as being “fatally flawed” and reminded NOAA of their responsibility through the federal Magnuson Stevens Act (MSA) tSen. Schumer Pt. Lookouto implement changes to the methodology used to gauge the level of recreational landings over the course of a season.

“We need better science and more data-based flexibility in our fishing management regulations,” said Schumer. “Keeping our fishing stocks healthy is absolutely critical, and to accomplish this we can’t base decisions on outdated science and poor methods. The current system not only falls short of achieving this goal, but it could take the Long Island fishing community down with it in 2010,” Schumer said adding that the fishing community “needs fairness and relief from flawed survey data now.”

MRFSS uses a combination of dockside interviews and evening telephone surveys to collect recreational harvest information.  In 2005, Congress convened a special hearing to look the MRFSS methodology, which in turn led to an in-depth analysis by the National Research Council (NRC) concluding that “both the telephone and access components of the current approach have serious flaws in design or implementation and use inadequate analysis methods that need to be addressed immediately.” Pat Sullivan, the NRC committee chair and a Cornell professor, referred to MRFSS specifically as “fatally flawed.”  The findings led to an MSA mandate that NMFS work on a new survey methodology which was supposed to be online and operational by the start of 2009. Federal delays however have pushed back the start date for MRIP until this year, which means MRFSS data is still regarded as “best available science” for estimating the annual recreational harvest.

Last week, Sen. Schumer asked Kurkul to issue an across-the-board moratorium on this flawed survey data in 2010 so that black sea bass and other species like fluke and porgies are not unfairly shutdown by bad science. “Acknowledging the problems with MRFSS, a new system mandated by the Magnuson-Stevens Act will be coming online in the coming years,” the senator wrote, adding “it would be patently unfair to punish anglers by reducing their quota due to erroneous landings estimates produced with a broken system.  I request that NMFS dismiss future recreational overages predicted by MRFSS until the new system is fully implemented and calibrated by NOAA.”

The Recreational Fishing Alliance recently posted a seven-page paper (Fatally Flawed Science – Killing America’s Number One Outdoor Pastime) pointing out many specific problems with MRFSS and outlining NRC’s view that experiential, narrative or local information from the fishing industry, currently considered purely “anecdotal” in nature by NMFS, should actually be considered in harvest methodology.  “When no other information is available, anecdotal information may constitute the best information available,” the NRC reported in its executive summary, adding “In addition, anecdotal information may be used to help validate other sources of information and identify topics for research.”

Schumer’s letter on behalf of anglers in the New York marine district can be greatly supported in many coastal states and is backed by a recent study conducted by the Connecticut Marine Fisheries Division (Correction for Systematic Bias in Recreational Catch, Harvest and Trip Estimates from the MRFSS since the year 2000) which noted a growing discrepancy between the estimated number of saltwater anglers according to MRFSS and the estimates of saltwater anglers from the US Fish and Wildlife Surveys (USFWS) and saltwater licenses sales from several Atlantic coast states.  Authored by fisheries assessment expert Dr. Victor Crecco, the report shows that MRFSS’ 2008 saltwater angler estimates were often “three to four times higher than both the 2006 USFWS estimates and the 2008 adjusted saltwater license sales,” findings which Dr. Crecco said “strongly suggest that the MRFSS has severely overestimated the number of saltwater anglers and fishing trips particularly in recent years, and by extension, has severely inflated the true recreational catch and harvest of all finfish species.”

Schumer is urging the U.S. Department of Commerce and the National Marine Fisheries Service (NMFS) to manage quotas based on sound data, and has instructed federal fisheries managers to dismiss any future overages estimated by MRFSS in order to restore some stability to coastal fishing communities.  “MRFSS has proven to be extremely dangerous on a year to year basis – especially with regard to last year’s surprising black sea bass shutdown – and this raises concerns about fully utilizing the meager summer flounder liberalization New York is entitled to in 2010,” Sen. Schumer added.

“Fishing is a Long Island tradition that has been passed down for generations and without this relief, the NMFS could potentially stick New York with another year of draconian cuts,” Schumer said. “The fishing community has made many sacrifices and stocks are improving so restricting families and others from fishing for them, based on bad data, in 2010 is just plain wrong.”

This past Saturday, Sen. Schumer visited the Freeport Recreation Center on Long Island and met with several hundred recreational fishermen at the New York Sportfishing Federation’s annual fishing expo.  “Fishing is one of our best industries in New York and you’ve been neglected for too long,” Schumer told the crowd of anglers and business owners, stressing the need to fix the Magnuson Stevens Act.  Schumer is lead sponsor of Senate Bill 1255, the Flexibility in Rebuilding American Fisheries Act and urged show patrons to join him in a  rally on the Capitol on February 24th while calling on “bureaucrats” to immediately fix the data collection system.

“We’ve got to change the rules here,” Schumer said to a loud applause.

Eric Schwaab Appointed as NMFS Assistant Administrator

Eric Schwaab has been appointed as Assistant Administrator to the National Marine Fisheries Service (NMFS). He brings more than 25 years of experience in local, state and federal natural resource management. Eric was a member of the Mid-Atlantic Fishery Management Council (Council) from 2000 to 2002 serving as Maryland’s State representative to the Council. He worked for many years at the Maryland Department of Natural Resources, including serving as Director of Maryland’s Fisheries Service and most recently as Deputy Secretary of Natural Resources.

While serving as a member of the Council, Eric demonstrated a strong conservation ethic and helped the Council in its development and implementation of the Tilefish Fishery Management Plan (FMP); Framework Adjustment 1 (instituting the Research Set-Aside Program) to the Atlantic Mackerel, Squid, Butterfish FMP, Summer Flounder, Scup, Black Sea Bass FMP, Bluefish FMP, the Tilefish FMP; and, Amendments 13 to the Summer Flounder, Scup, and Black Sea Bass and Surfclam and Ocean Quahog FMPs. During his tenure on the Council, Eric served on the Demersal, Ecosystems, and Law Enforcement Committees.

2010 National Saltwater Angler Registry

Saltwater recreational fishermen have long expressed concerns about the data used to estimate the effects of recreational fishing on ocean resources and the nation’s economy. The National Saltwater Angler Registry, which launches on Friday, will help address that concern by providing a comprehensive list of the nation’s saltwater anglers that will be used to improve surveys of fishermen. These surveys are used by NOAA scientists to assess the health of fish stocks and to estimate the economic contributions of anglers.

Many saltwater recreational fishermen will be required to register before fishing in 2010. The registry is open for registrations starting Friday, January 1. But if you have a state saltwater fishing license, you may already be part of the registry.

“By registering, recreational anglers will make their catch count,” said Jim Balsiger, acting NOAA assistant administrator for NOAA’s Fisheries Service. “The National Saltwater Angler Registry is an important tool that will enable us to better estimate the health of marine fisheries so that we’re able to preserve the pastime of recreational saltwater fishing for generations to come.”

“Recreational fishers need the registry,” says Capt. Monty Hawkins, a party boat operator and recreational fishing advocate based in Ocean City, Md. “People’s lives depend on the quality of the government’s information. It’s the basis for management decisions on everything from creel limits to whether to shut down whole sections of the coast. I’ve been harshly critical of recreational fishing data in the past, but I welcome the registry as a way to improve upon the current system.”

Gordon Colvin, a biologist with NOAA’s Fisheries Service and interim senior policy advisor on recreational fishing to Balsiger, who has spearheaded the registry implementation, said that many anglers will not need to take any action to register, because their coastal states already have agreements in place with NOAA to share state saltwater fishing license information.

Who Needs to Register:

Recreational saltwater fishermen will need to register if they:

• Hold a license from one of 10 coastal states or territories which do not currently have comprehensive saltwater angler license or registration requirements—Hawaii, Maine, Maryland, Massachusetts, New Jersey, New Hampshire, Puerto Rico, Rhode Island, Virginia, and the U.S. Virgin Islands.

• Fish for or are likely to catch anadromous species in tidal and salt waters; these are fish like river herring, shad, smelt and striped bass that live in the oceans but spawn in fresh water, OR

• Fish in the federal waters more than three miles from the ocean shore or from the mouths of rivers or bays

Who Doesn’t Need to Register

Some anglers don’t have to register if they:

• Hold a license from one of 15 coastal states with comprehensive licensing or registration — Alabama, Alaska, California, Connecticut, Delaware, Florida, Georgia, Louisiana, Mississippi, New York, North Carolina, Oregon, South Carolina, Texas, Washington;

• Are not required under state law in one of these 15 states to hold a fishing license as is sometimes the case with seniors or active-duty military;

• Are under age 16;

• Pay to fish on licensed charter, party or guide boats;

• Hold a Highly Migratory Species Angling permit or subsistence fishing permit;

• Fish commercially under a valid license.

National Saltwater Angler registration is free in 2010. To register beginning Friday, anglers can visit http://www.countmyfish.noaa.gov and click on the Angler Registry link, or call the toll-free registration line at 1-888-MRIP411 (1-888-674-7411) from 4:00 am to 12 midnight EST daily.

Anglers will need to provide their name, date of birth, address and telephone number, and will receive a registration number that will allow them to begin fishing immediately. They will receive a registration card in the mail in about 30 days.

Steve Medeiros, executive director of the Rhode Island Saltwater Anglers Association and a leading advocate for a saltwater fishing license in his state, said the registry is an important step. “While it’s true that some fishermen don’t like the idea of having to register to participate in a sport they’ve taken for granted their whole lives, anyone fishing today knows that increasing pressures on the ocean are having a real effect,” he said. “If we’re going to pass the sport down to our children and grandchildren, we’re going to need sound management based on good data.”

The registry will be used as the basis for conducting surveys of saltwater recreational fishermen to find out how often they fish. It will eventually replace the use of random-digit dialing to coastal households, a system NOAA has had in place since the 1970s. The goal is to improve survey efficiency and reduce bias by making calls only to homes where people fish, and reaching saltwater anglers who live outside coastal counties.

While the registry is among the most visible aspects of NOAA’s Marine Recreational Information Program, it is only one component of this rigorous multi-year, multi-phased overhaul of the system NOAA uses to collect and report recreational fishing data. Each piece of its design and implementation has been guided by close working relationships among NOAA personnel, fisheries managers, state partners, independent scientists and the recreational fishing community.

Top Virginia Live Baits for Saltwater Fishing

Spot

Spot are named and identified by the distinctive dark spot above the pectoral fin. The species is also known as lafayette, goody, or Norfolk spot. Spot are common from Cape Cod to Florida and through the Gulf of Mexico. Spot rarely exceed 10 inches in length, making them highly sought after as live baits. These fish are abundant in the Chesapeake Bay, coastal bays, rivers, creeks and other estuaries of Virginia.

Atlantic Croaker

The Atlantic croaker, also known as croaker or hardhead are a common bait for sea trout, striped bass and for offshore fishing. Croaker usually arrive in large numbers in summer, moving into the ocean in fall.

Pinfish

Pinfish, also known as sailor’s choice, or pin perch is sometimes caught It ranges from Massachusetts through the Gulf of Mexico, being more abundant from Virginia south. Pinfish are known to coastal anglers as a “bait stealer,” but are sought after as a live bait for other larger fish. Pinfish are  Pinfish are typically 4-8 inches in length.

Pigfish

Pigfish are colorful members of the grunt family. They are marked with a bluish upper and a silver lower body. Each scale has a blue center and bronze edge, which forms a series of yellow-brown stripes on the sides and sometimes exhibits orange bands on the snout and head. The full range of pigfish extends from Massachusetts through the Gulf of Mexico, although they are rare north of Virginia. Pigfish make excellent live baits for striped bass, cobia, sharks and other species.

Silver Perch

Silver perch, also known as silver croaker ranges from New York southward through the Gulf of Mexico to northern Mexico. Because of its relatively small size, the silver perch are popular as a live bait species but is occasionally harvested for the table.

Striped Mullet

Striped mullet are common in the back bays, creeks and in the surf. Immature mullet are 3 to 8 inches long, making an excellent choice for live bait. The fish have a rounded, silvery body, dark bluish green back and dark stripes on the sides, and a small mouth. Striped mullet can often be seen jumping to evade predators.

Atlantic Menhaden

The Atlantic menhaden is a toothless herring with a blue, blue-green or blue-brown body. The sides, fins and belly are silvery, often with a yellowish sheen. Menhaden are a favorite prey of many predatory fish and other species, including bluefish, weakfish, striped bass and others. Small menhaden can be caught in creeks, sheltered coves and canals using cast nets or seines.

Atlantic Herring

The Atlantic herring is one of the most abundant species of fish on the planet . They are small, pelagic fish known for their schooling tendencies. Herring are iridescent, greenish or grayish blue dorsally with a silvery abdomen and sides. They can occasionally be caught in the late winter or early spring using jigs and make excellent baits for predatory fish found off the coast of Virginia.

Atlantic Silverside

Atlantic silversides live in small creeks and shallow areas. They are an important forage fish for predators such as striped bass, bluefish, weakfish and Spanish mackerel. Silversides are caught with seines, traps or small mesh cast nets. Their small size makes them difficult to fish as live baits but the results can be well worth the effort.

“United We Fish” Protest in Washington DC – February 24, 2010

In a historic show of solidarity, recreational and commercial fishermen will gather together on the steps of the Capitol on February 24, 2010 from noon until 3 p.m. in an organized demonstration against the unintended negative impacts of the Magnuson Stevens Conservation and Management Act (MSA), the federal fisheries law which was revised in January of 2007.  Coordinating the march under the flag of United We Fish, rally organizers are hoping to see a large show of force in defense of coastal communities.

“The closures keep coming and it’s good to see the collective fishing communities and industries, both recreational and commercial, calling for scientific based Magnuson reform,” said Jim Donofrio, Executive Director of the Recreational Fishing Alliance (RFA).  “We are all in this together.”  Donofrio cited recent closures of amberjack, black sea bass and red snapper fisheries as examples of what he calls a “broken” federal fisheries law.

The groups organized through United We Fish are hoping to prove to legislators just how many American anglers and business owners are truly being impacted by the overly restrictive management requirements created by MSA based on non scientific arbitrary deadlines.  According to Bob Zales of the Conservation Cooperative of Gulf Fishermen (CCGF), the time-specific deadlines mandated by MSA coupled with flawed data collection methods are forcing anglers off the water.  “We fully support real science based management and the conservation of our marine resources while also being able to sustain recreational and commercial fishing activities, providing locally caught seafood, sustaining small family businesses, and supporting our coastal communities.”

This effort is being coordinated by many organizations and individuals including but not limited to the RFA, CCGF, United Boatmen of New York, United Boatmen of New Jersey, New York Sportfishing Federation, Maryland Saltwater Sportfishermen’s Association and the Fishing Rights Alliance.  “Some people have asked ‘why, it’s winter’,” said Donofrio who said he’s gotten the required permits and expects a large crowd in DC on February 24th, regardless of weather. “We can’t let seasons stop the momentum, and if we wait any longer none of us will be fishing.  Many members of Congress will be standing shoulder to shoulder with us,” Donofrio said.

Nils Stolpe, a consultant to the commercial fishing industry and columnist for SavingSeafood.org said that over the past three decades since the original Magnuson Act was established, fishermen have been gradually phased out of the fisheries management process, regardless of sector.  “The scientists have been put in charge, and as the list of closures and restrictions up above painfully demonstrates, the Act has been turned into a weapon that is now being used against fishermen and fishing communities.”

U.S. Rep. Frank Pallone, Jr. (D-NJ) first introduced the Flexibility in Rebuilding American Fisheries Act of 2008 in the 110th Congress to incorporate “limited flexibility” into federal fisheries management.  More than 100 fishing groups and industry members from around the country pledged their support for the legislation and the bill’s 19 bipartisan coastal cosponsors, but the bill languished during the volatile economic climate in advance of the presidential elections in November of 2008.

Realizing that fisheries closures would continue without congressional intervention, in March of this year, Rep. Pallone and fellow Representatives John Adler (D-NJ), Henry Brown, Jr. (R-SC), Ginny Brown-Waite (R-FL), Barney Frank (D-MA), Walter B. Jones, Jr. (R-NC), Patrick Kennedy (D-RI), Frank LoBiondo (D-NJ), Mike McIntyre (D-NC), Michael Michaud (D-ME), Solomon Ortiz (D-TX) and John Tierney (D-MA), reintroduced the Flexibility in Rebuilding American Fisheries Act of 2009 (HR 1584).  Twenty-five total co-sponsors have since pledged support to date including Rob Andrews (D-NJ), Timothy Bishop (D-NY), Allen Boyd (D-FL), Joe Courtney (D-CT), Peter King (R-NY), Rob Wittman (R-VA), Jo Bonner (R-AL), John Mica (R-FL), Ileana Ros-Lehtinen (R-FL), Carol Shea-Porter (D-NH), Clifford Stearns (R-FL), Donna Christensen (D-VI), Gus Bilirakis (R-FL), and Ander Crenshaw (R-FL).

Following a letter-writing campaign by the RFA-NY and members of the New York Sportfishing Federation, senior Democratic Senator Charles Schumer of New York announced his Senate version of the bill (S.1255).  Currently, the Senate bill to correct the flaws in MSA has no co-sponsors, which is something United We Fish organizers are hoping will change in February.

“New York’s Senator Schumer is as concerned about his fishing constituents as he is about the fish, just as Congressmen Pallone, Frank, Jones, LoBiondo, Kennedy, Adler and others in the House of Representatives are,” said Stolpe.  “Hence they have formed the nucleus of a growing movement in Congress that, in spite of the editorial opinion of the New York Times and the expenditure of many millions of dollars by the Pew Charitable Trusts, is aimed at preserving recreational and commercial fishing, the lifestyles of millions of fishermen, and the tens of thousands of businesses and hundreds of fishing communities that they support,” Stolpe added.

Organizers from within the recreational fishing sector are hoping to get commitment from all user groups and across varied state and regional boundaries.  “This is much bigger than any one state issue or individual grievance,” said RFA’s Managing Director Jim Hutchinson, Jr.  “Whether it’s our restrictive fluke fishery in New York, the arbitrary closure of state waters for our anglers in California, or the shutdown of red snapper and amberjack down south, our community has been divided by preservationist tactics for too long.  It’s time to unite the clans in defense of our coastal heritage and traditions,” Hutchinson said.

“We need to let Congress and NOAA know that we are the collective voice of the recreational fishing community and the collective voice does not accept the current broken management system which wreaks such havoc on all of us and our businesses,” said Donofrio, adding “The goal on February 24th will be to get all of our congressional friends to attend.”

“At this point Senator Schumer and his Congressional colleagues in the House deserve the thanks and the support of every one of us who fishes, whether for fun or profit,” said Stolpe.

States Schedule Public Hearings on Spanish Mackerel, Spot, and Spotted Seatrout

Several South Atlantic states have scheduled their hearings to gather public comment on the Public Information Document (PID) for an Omnibus Amendment to the Interstate Fishery Management Plans (FMPs) for Spanish Mackerel, Spot, and Spotted Seatrout. As the first step in the development of an amendment, the PID presents a broad overview of the issues facing these three species. It provides the public with the opportunity to tell the Commission about changes observed in the fisheries; actions that should or should not be taken in terms of management, regulation, enforcement, and research; and any other concerns about the resources or the fisheries.
The PID and subsequent amendment are being developed to update the three species management plans to include compliance measures and other Commission standards since all three plans are voluntary in nature and lack standards that were developed in response to the Atlantic Coastal Fisheries Cooperative Management Act (e.g., adaptive management, de minimis criteria). In the case of Spanish mackerel, the PID will also address modifying the Commission’s management program so that it is consistent with federal management in the exclusive economic zone (because the plan is intended to track federal Spanish mackerel measures).

Following the initial phase of information gathering and public comment, the Commission will evaluate potential management alternatives and develop a Draft Omnibus Amendment for public review. Following the second public comment period, the Commission will specify management measures to be included in the final amendment. A tentative schedule for completion of the Omnibus Amendment is included in the PID.

Fishermen and other interested groups are encouraged to provide input on the PID, by either attending public hearings or providing written comments. NOAA Issues Statement on ICCAT Annual Meeting

On November 16, 2009, NOAA issued a statement about the outcome of the annual meeting of the International Commission for the Conservation of Atlantic Tunas (ICCAT) meeting in Brazil.

STATEMENT

“As a member of ICCAT, the United States entered this meeting seeking the strongest possible agreement for the conservation of the eastern Atlantic and Mediterranean bluefin tuna,” said Dr. Jane Lubchenco, under secretary of commerce for oceans and atmosphere and NOAA administrator.

The ICCAT agreement on eastern Atlantic and Mediterranean bluefin tuna is a marked improvement over the current rules, but it is insufficient to guarantee the long-term viability of either the fish or the fishery. While we are disappointed that the total allowable catch is not lower, we strongly support the commitment to set future catch levels in line with scientific advice, shorten the fishing season, reduce capacity, and close the fishery if the stocks continue to decline. We remain committed to pursuing every legitimate avenue to recover Atlantic bluefin tuna and ensure their long-term survival.

Dr. Rebecca Lent, director of the Office of International Affairs at NOAA’s Fisheries Service and the head of the U.S. delegation at ICCAT said, “Negotiations were extremely challenging this year at ICCAT. The United States sought a package of measures for eastern Atlantic and Mediterranean bluefin tuna that would halt overfishing and provide for rebuilding by 2023 with a high probability of success. The science indicates that a total quota level of 8,000 metric tons or lower would have achieved that. While I am pleased with the commitments for significantly lower quotas next year, I am disappointed that parties did not take immediate measures to significantly reduce the quota for the 2010 season.”

Importantly though, under U.S. leadership in the Compliance Committee, ICCAT made unprecedented progress and held countries accountable for compliance infractions through formal identifications. These identifications can be the basis for future sanctions and are intended to, among other things, help reduce illegal fishing and improve submission of fishing data, which is crucial for scientific projections. In addition, ICCAT adopted a U.S-sponsored framework for presentation of future scientific advice that will facilitate the use of a precautionary management approach.

Background:

This year, as in years past, U.S. negotiators sought a suite of management measures that would end overfishing and help rebuild stocks of Atlantic bluefin tuna. Over the past decade, countries that fished in the eastern Atlantic and Mediterranean did so at two to three times the sustainable level, causing a significant and rapid decline in the stock.

At its annual meeting, which ended late Sunday November 15, ICCAT adopted the following agreements:

ICCAT has agreed to a total allowable catch limit of 13,500 metric tons for eastern Atlantic Mediterranean bluefin tuna, down from the 2009 limit of 22,000 metric tons. Importantly, this measure also commits to a science-based catch level for 2011 to 2013 with a 60 percent probability of rebuilding the stock to healthy levels by 2023, lengthens the existing purse seine fishing closure for 30 days during the critical spawning period, freezes all joint fishing operations to enhance compliance, and commits to reducing fishing capacity.

ICCAT adopted a science-based rebuilding program for northern albacore tuna intended to rebuild the stock within 10 years and strong conservation and management measures for Bigeye tuna that reduces harvest levels in line with scientific advice.

ICCAT adopted a binding measure to prohibit retention of bigeye thresher sharks which are considered highly vulnerable by scientists.

ICCAT lowered the quota for North Atlantic swordfish to 13,700 metric tons to comply with scientific advice and extended the allocation arrangement that was previously in place. As part of this measure, the United States and Canada committed to develop a joint scientific program to examine ways to reduce sea-turtle bycatch in the swordfish fishery. Results will be presented at the 2010 ICCAT meeting.

ICCAT adopted a new process for providing scientific advice that will give managers clear information on the levels of risk and the timeframes involved in meeting fisheries management goals. This is a key step towards better incorporating precautionary and science-based management approaches.

La Princesa Barge Pulled from Beach Near Sandbridge Pier

Titan Salvage crews successfully pulled the barge La Princesa off Sandbridge beach at 7:48 a.m. Wednesday, November 18, 2009.

The crews used two tugs pulling together on the bow and stern of the barge at high tide to free it. The barge, which broke free from the tug Sentry Thursday night, grounded on the beach near Little Island Pier Friday morning.

Coast Guard, Crowley and Titan Salvage personnel worked together to remove the barge from the beach while ensuring the safety of the public and environment. Coast Guard inspectors and a member of the American Bureau of Shipping will survey the vessel to ensure that it is seaworthy. Once the survey team is satisfied, the tug Sentry will tow the barge to its next port of call in Pennsauken, N.J.

NMFS Proposes Changes to Atlantic Bluefin General and Harpoon Category Fisheries
